Terms of Service

Last updated: August 10, 2026

These Terms explain the rules for using Split 60 Golf. They should be read with our Privacy Policy.

1. Agreement to These Terms

These Terms of Service (“Terms”) govern your access to and use of Split 60 Golf, including split60golf.com, the Split 60 Golf web application, public pages, practice sessions, Swing Coach, Fix Your Game, progress tracking, and related services (the “Service”).

By creating an account, accessing the app, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

If you use the Service on behalf of a business, club, school, team, or other organisation, you confirm that you have authority to bind that organisation to these Terms.

2. Eligibility

You must be at least 13 years old to use the Service. If the law where you live requires a higher age to use online services or consent to data processing, you must meet that higher age requirement.

If you are under the age of majority where you live, you may use the Service only with permission from a parent or legal guardian.

You may not use the Service if you are prohibited from doing so under applicable law or if we previously suspended or terminated your account for violating these Terms.

3. Accounts and Security

You may need an account to access the app. You agree to provide accurate account information, keep it updated, and protect your login credentials.

You are responsible for activity that occurs through your account unless the activity results from our failure to use reasonable security measures.

Notify us promptly at [email protected] if you believe your account has been compromised.

We may suspend or restrict accounts where we reasonably believe there is unauthorised access, security risk, fraud, abuse, or violation of these Terms.

4. The Service

Split 60 Golf provides structured golf practice sessions, drill guidance, swing thoughts, practice tracking, game-area progress, Fix Your Game recommendations, and Swing Coach analysis tools.

The Service may generate or recommend drills, practice plans, scoring games, swing cues, and training priorities based on the information you provide and your practice history.

We may add, remove, change, limit, or discontinue features at any time. We will try to avoid disrupting core paid functionality without reasonable notice where practical.

5. Coaching, Safety, and No Professional Advice

Split 60 Golf is an educational and practice-planning tool. It is not a substitute for advice from a qualified golf professional, medical professional, physiotherapist, or other specialist.

Golf practice can involve physical exertion and risk of injury. You are responsible for practising safely, warming up appropriately, using suitable equipment, checking your surroundings, and stopping if you feel pain, dizziness, or unsafe conditions.

Swing Coach analysis and practice recommendations are based on available data and software estimates. They may be incomplete, inaccurate, or unsuitable for your body, skill level, course conditions, or goals.

You are responsible for deciding whether to follow any drill, swing cue, session, or recommendation. If you have an injury, medical condition, or physical limitation, seek advice from a qualified professional before using the Service.

6. User Content

“User Content” means information you submit or create through the Service, including profile details, goals, handicap, practice notes, swing thoughts, problem descriptions, session results, scores, feedback, and any future uploaded or shared content.

You keep ownership of your User Content. You grant Split 60 Golf a worldwide, non-exclusive, royalty-free licence to host, store, process, display, reproduce, modify, and use your User Content as necessary to provide, secure, support, and improve the Service.

You confirm that you have the rights needed to submit your User Content and that it does not violate law, infringe another person’s rights, or contain unlawful, harmful, abusive, defamatory, or misleading material.

We may remove or restrict User Content if we reasonably believe it violates these Terms, creates risk, or could harm users, us, or third parties.

7. Swing Recordings and Analysis Data

The native Split 60 Golf iPhone app may let you record video locally. As described in the Privacy Policy, raw swing videos are intended to remain in private storage on your iPhone and are not intentionally uploaded to our servers as part of normal analysis.

When you save an analysis, you authorise us to store and process derived data such as landmark coordinates, angles, checkpoint data, issue labels, scores, and recommendations.

You are responsible for obtaining consent from anyone who appears in any recording you make, for following local recording laws, and for making sure you record only where it is safe and permitted.

8. Acceptable Use

You agree not to misuse the Service, interfere with its operation, access it using unauthorised methods, bypass access controls, scrape or harvest data, reverse engineer protected parts of the Service, or test security without permission.

You agree not to upload, submit, or transmit malicious code, spam, unlawful material, abusive content, misleading information, or content that infringes someone else’s rights.

You agree not to use the Service to build a competing product by copying our content, workflows, drills, analysis outputs, designs, or data structure except where law expressly permits it.

You agree not to share your account credentials, resell access, or use the Service in a way that harms other users, Split 60 Golf, our vendors, or the public.

9. Intellectual Property

The Service, including software, design, branding, logos, graphics, text, drill structures, practice frameworks, content, recommendations, and other materials, is owned by Split 60 Golf or its licensors and is protected by intellectual property laws.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your own golf practice and improvement.

You may not copy, modify, distribute, sell, lease, publicly display, create derivative works from, or exploit any part of the Service except as allowed by these Terms or with our written permission.

Feedback you provide may be used by us without restriction or compensation to you, but we will not claim ownership of your underlying User Content merely because you provide feedback.

10. Subscriptions, Payments, and Trials

Some features may be free and others may require a paid subscription. Pricing, plan limits, billing periods, trial terms, and included features will be shown at or before purchase.

If you purchase a paid plan, you authorise us and our payment processor to charge the applicable fees, taxes, and renewal charges using your selected payment method.

Subscriptions may renew automatically unless cancelled before the renewal date. You are responsible for cancelling through the method provided in the Service or by the relevant app store or payment provider if applicable.

Except where required by law or expressly stated at purchase, fees are non-refundable and we do not provide credits for partial billing periods.

We may change prices or plan features with reasonable notice. Changes will not affect the current paid term unless permitted by law or you agree to the change.

11. Third-Party Services

The Service may rely on third-party services for hosting, authentication, email, analytics, payments, error monitoring, AI or pose-analysis tooling, and other functionality.

Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party services, websites, content, or practices.

If you sign in with Google or another provider, your use of that provider remains subject to its own terms and policies.

12. Beta Features and Changes

Some features, including Swing Coach or AI-assisted features, may be labelled beta, experimental, preview, or similar. Beta features may be less reliable, less accurate, or changed more frequently than mature features.

We may modify, suspend, or discontinue any beta feature at any time, including where needed for safety, quality, legal compliance, or product direction.

13. Disclaimers

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of accuracy, fitness for a particular purpose, merchantability, non-infringement, uninterrupted availability, and error-free operation.

We do not guarantee that the Service will improve your golf scores, fix your swing, prevent injury, provide perfect recommendations, or be available at all times.

Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

14. Limitation of Liability

To the maximum extent permitted by law, Split 60 Golf and its owners, directors, employees, contractors, suppliers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, personal injury, or business interruption arising from or related to the Service.

To the maximum extent permitted by law, our total liability for any claim arising from or related to the Service will not exceed the greater of the amount you paid to Split 60 Golf for the Service in the three months before the event giving rise to the claim or USD $100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, intentional misconduct, or rights that cannot be waived by consumers.

15. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Split 60 Golf and its owners, employees, contractors, suppliers, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from your misuse of the Service, violation of these Terms, User Content, infringement of rights, or violation of law.

This indemnity does not apply to the extent a claim results from our own unlawful conduct or from rights that cannot be waived under applicable consumer law.

16. Suspension and Termination

You may stop using the Service at any time. You may request account deletion by contacting [email protected].

We may suspend or terminate access if you violate these Terms, create legal or security risk, misuse the Service, fail to pay fees, or if continuing to provide the Service is no longer commercially or legally practical.

After termination, your right to use the Service ends immediately. Sections that by their nature should survive termination will survive, including intellectual property, payment obligations, disclaimers, liability limits, indemnity, dispute terms, and provisions relating to stored data.

17. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and may provide notice through the Service or by email.

If you continue using the Service after updated Terms take effect, you agree to the updated Terms. If you do not agree, you must stop using the Service.

18. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction where the operator of Split 60 Golf is established, unless mandatory consumer law in your place of residence requires otherwise.

Before starting a formal dispute, you agree to contact [email protected] and try to resolve the issue informally. We will try to do the same.

Nothing in these Terms limits any mandatory rights you have under the laws of the country or state where you live.
